Important Update
Last year, President Biden directed the Occupational Safety and Health Administration (OSHA) to issue an Emergency Temporary Standard (ETS) requiring that all private employers with 100 or more employees mandate their workforce be vaccinated or submit to weekly COVID-19 testing. OSHA published the ETS on November 5, 2021, however, several employers immediately filed lawsuits challenging OSHA’s authority to enact the ETS. On January 13, 2022, in a 6-3 decision, the United States Supreme Court voted to block enforcement of the ETS, and on January 25, 2022, OSHA officially withdrew its enforcement of the ETS.
Although private employers are no longer obligated to comply with the ETS, it is still essential that employers remain aware of state and local laws that may require (or in some cases prohibit) mandatory vaccination policies. Employers that are federal contractors and/or healthcare providers participating in the federal Medicare/Medicaid program may still have vaccination, testing and other workplace requirements that apply to their operations.
